This Electronic Record and Signature Disclosure (shortened either as “ERSD” or “Notice”) contains important information about your legal rights. The Electronic Signatures in Global and National Commerce Act (2000) (“E-Sign Act”) requires Chapel Thrill Escapes (we, us, or Company) to provide specific disclosures to you in writing (“Required Information”), which means you have a right to receive that information in paper form. We may provide these disclosures to you electronically if you receive this ERSD and you provide consent to receive such disclosures electronically. Your consent to receive this information electronically will apply to all Required Information, to include consent to sign and execute subsequent legally binding agreements and documents described in more detail in the Scope section below, subject to the North Carolina Uniform Electronic Transactions Act ("UETA") and other applicable law. Your consent will also apply to any other person(s) included as a participant or co-executor of these agreements, subject to applicable law. Please read the information below carefully and thoroughly, and if you can access this information electronically to your satisfaction agree to this ERSD, please confirm your agreement by selecting the checkbox next to “I AGREE TO USE ELECTRONIC RECORDS AND SIGNATURES” before clicking “NEXT” within our e-Sign Waiver Portal (“System”).

Scope

Your consent will apply to the execution and transaction of the Chapel Thrill Escapes Participant Accident, Risk, and Release of Liability Waiver (“Waiver”) and the Terms and Conditions (“T&C)”, which contains various policies of Chapel Thrill Escapes relevant to your participation in our activities. Your consent may also cover addendums made the Waiver which can be executed after mutual consideration and additional signatures of the parties. Your consent will apply to the duration of the single transaction to participate in our escape room. Your consent will only apply to this individual transaction for the purchase of participating in a time-barred Chapel Thrill Escapes room. All electronically provided documents covered by this ERSD are collectively referenced and incorporated as “Agreements".

Obtaining Paper Copies of the Agreements

We recommend that you print or download a copy of this ERSD, and Agreements to retain for your records. Our System easily permits the ability to do so.

If you decline to provide your consent to receive and sign the Waiver electronically, you may receive a paper copy of all documents provided electronically by asking an employee during normal business hours (as applicable to the T&C), contacting us at admin@chapelthrillescapes.com, or writing to us at 128 E. Franklin St. Suite 110, Chapel Hill, NC 27514. You may also receive a paper copy of Agreements provided electronically by following the above instructions. We will retain a copy of all Agreements provided electronically for a period as required by federal law.

You may obtain a paper copy of any documents at no cost and at no consequence for your participation in any activities provided by Chapel Thrill Escapes during the transaction and business relationship.

How to Withdraw Your Consent

If you elect to receive required notices, disclosures, and records from us electronically, you may at any time change your mind and tell us that thereafter that you want to receive required notices, disclosures, and records only in paper format. You can withdraw your consent at no consequence or cost. To do so, you may:

1. Write to Chapel Thrill Escapes at 128 E. Franklin St. Suite 110, Chapel Hill, NC 27514 stating your intent to withdraw consent, your full name, mailing address, telephone number, and date of last booking for one of our escape rooms; or
2. Send us an email at admin@chapelthrillescapes.com and in the subject line state “ATTN: ELECTRONIC RECORD AND SIGNATURE CONSENT WITHDRAWAL” and in body of such a request you must state your email, full name, mailing address, telephone number, and date of last booking for one of our escape rooms.

Your withdrawal of consent is effective only after Chapel Thrill Escapes has had a reasonable period of time to act upon your withdrawal.

Withdrawal of consent to electronic delivery will not affect the legal effectiveness, validity, or enforceability of the Agreements previously provided and signed electronically, subject to your prior consent.

Hardware and Software Requirements

To access and retain the Agreements and this ERSD, your must have an active email address and an active email address and up-to-date computing or mobile device with:

• a Current Version (defined below) of a web browser (such as Edge, Chrome, Safari or Firefox),
• a connection to the Internet,
• electronic storage to retain records and/or a printer to print them, and
• a Current Version of a program that accurately reads and displays PDF files.

If you do not have a PDF reader, you can download Adobe® Reader® at no charge from the following link: https://get.adobe.com/reader/.

By “Current Version,” we mean a version of the software that is currently being supported by its publisher. We reserve the right to discontinue support of a Current Version of software if, in our sole opinion, it suffers from a security flaw or other flaw that makes it unsuitable for use.

If our hardware or software requirements change, and that change creates a material risk that you would not be able to access or retain the information contained in www.chapelthrillescapes.com, we will give you notice of the revised hardware or software requirements. Continuing to access www.chapelthrillescapes.com or our System electronically after receiving notice of the change reaffirms your consent.

Termination and Changes

We reserve the right to discontinue providing you with an electronic version of Agreements, or to terminate or change this ERSD. We will provide you with notice of any such termination or change as required by law.

Your Contact Information

If your email address or other contact information is changed, you must notify Chapel Thrill Escapes of such changes immediately through www.chapelthrillescapes.com, write to Chapel Thrill Escapes at 128 E. Franklin St. Suite 110, Chapel Hill, NC 27514, or at admin@chapelthrillescapes.com. We are not responsible if you do not receive an email notification.

If you fail to update or change an incorrect email address or other contact information, you understand and agree that any electronic Agreements shall nevertheless be deemed to have been provided to you if they were made available to you in a manner compliant with the E-Sign Act.

Acknowledging Your Access and Consent to Receive and Sign Documents Electronically

To confirm to Us that you can access this information electronically, which will be similar to other electronic notices and disclosures that we will provide to you, please confirm that you have read this ERSD, and (i) that you are able to print on paper or electronically save this ERSD for your future reference and access; or (ii) that you are able to email this ERSD to an email address where you will be able to print on paper or save it for your future reference and access. Further, if you consent to receiving notices and disclosures exclusively in electronic format as described herein, then select the check-box next to ‘I agree to use electronic records and signatures’ before clicking NEXT within our System.

By selecting the check-box next to ‘I agree to use electronic records and signatures’, you affirm that:

1. You can access and read this Electronic Record and Signature Disclosure using the minimum hardware and software requirements; and You can print on paper this Electronic Record and Signature Disclosure, or save or send this Electronic Record and Disclosure to a location where you can print it, for future reference and access; and
2. Until or unless you notify Chapel Thrill Escapes as described above, you consent to use electronic records and signatures for the execution of Agreements and that your electronic signature is legally valid and has the same force and effect as if it had been executed on paper by wet ink signature and the physical originals were delivered. Your consent is not required for executing the Agreements; and
3. You understand that you have the option to withdraw your consent or request paper documents at any time; and
4. You hereby waive any claim or defense that any Agreements are/is not binding or enforceable or does not have its intended effect as a result of being communicated electronically rather than in writing.

Under federal law, you have the express Right to Withdraw this consent. Please see the section How to Withdraw Your Consent for instructions on exercising this right.

If you decline to provide your consent to this ERSD, please immediately inform an employee during normal business hours (as applicable to the T&C) prior to clicking “NEXT” in our System and signing Agreements provided electronically. If you continue nonetheless, you acknowledge that you have waived your right to decline prior consent, notwithstanding your right to withdraw consent at any time.
